Advertising services taken by schools, Academies, free schools, and other educational establishments (together “Educational Settings”) are governed by additional terms of service, which are set out in Additional Terms for Educational Settings.  For advertising services, the General Terms of Website Use and Additional Terms for Educational Settings must be read together.

For Educational Settings, or persons representing Educational Settings, the General Terms of Website Use and Additional Terms for Educational Settings apply in all instances.   

By using our site, you indicate that you accept these terms of use and that you agree to abide by them.

If you do not agree to these terms of use, please refrain from using our site.

www.teachinherts.com is a site operated by Herts for Learning Ltd (HfL).

1. Intellectual property rights

1.1 Unless indicated otherwise, we are the owner or licensee of all intellectual property rights in this website and in the materials published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

1.2 All brand names, product names and/or service names used in this website are trademarks, trade names, service marks or copyrights of Herts for Learning. Any use of any such brand name, product name and/or service name without the express, prior, written consent of Herts for Learning may constitute an infringement of those rights and Herts for Learning gives no permission for the use of any such item in any way whatsoever.


2. Limited permission to copy or download

2.1 You are permitted to print or download extracts from this website for your own personal, non-commercial use. Herts for Learning's status, and that of any identified contributors as the author of any materials on the website, must always be acknowledged.

2.2 Any copies of these pages saved to disk or to any other storage medium may only be used for subsequent viewing purposes or to print extracts for your own personal, non- commercial use. www.hertsforlearning.co.uk may provide access via hypertext or other links to resources in other websites. These links shall be for browsing only and in so doing Herts for Learning does not endorse any linked entities nor authorise any act which may be in breach of copyright or any other third party rights which are protected in law or by international treaties world-wide. Herts for Learning does not accept any responsibility or liability for privacy practices or the content on any third party website.

4. Links to www.teachinherts.com

4.1. Users should not set up links from their own websites to any part of the Teach in Herts website (whether by hypertext linking, deep-linking, framing, tagging or otherwise) without the prior written consent of Herts for Learning. Any request for consent to link to the www.teachinherts.com website should be sent by email to teachinherts@hfleducation.org. Herts for Learning may, at its absolute discretion, and without providing a reason, grant or withhold such consent.

4.2 Herts for Learning reserves the right to withdraw linking permission without notice.

4.3 You should not assume that because you reached our website via a link from a third party site that Herts for Learning has given its consent to such a link.

5. Information and limitation of our liability

5.1 The contents of this website provided by Herts for Learning are only for general information or use.  All your dealings with Educational Settings, including but not limited to employment advertisements on the website and the submission of employment applications by you, are solely between you and such Educational Setting.

5.2 Herts for Learning uses reasonable care to make sure that information which it provides for the website is accurate and up to date. However, errors and omissions do occur and you should independently verify the accuracy of the information yourself before placing any reliance upon it.

5.3 The material displayed on the site is provided without any guarantees, representations, conditions or warranties as to its accuracy, completeness or being up-to-date.

5.4 Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

 6. Virus protection

6.1 Herts for Learning makes no warranty that the contents of this website or any other website which may be visited from www.teachinherts.com are free from infection by bugs or viruses or anything else that has contaminating or destructive properties and users are advised to take all appropriate steps (including the use of up-to-date anti-virus software) to minimise the impact of any such viruses or similar items.

6.2 You must not misuse the site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the site, the server on which the site is stored or any server, computer or database connected to the site. You must not attack the site via a denial-of-service attack or a distributed denial-of service attack.

6.3 By breaching clause 6.2, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the site will cease immediately.

6.4  Herts for Learning will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

7. Changes to access or content of the web site

7.1 Herts for Learning may alter without notice the arrangements for access to this website or change the content, presentation and/or facilities of this website.  Please also note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it.

7.2 If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

8. Access to the website

Herts for Learning does not guarantee uninterrupted and/or reliable access to this website and Herts for Learning makes no guarantees whatsoever as to its operation, availability, functionality or otherwise. Further, Herts for Learning expressly reserves the right (without giving notice) to discontinue access to this website at any time and for any reason. Herts for Learning shall have no liability to in the event that this website is unavailable at any time and whether such non-availability is temporary or permanent.

9. www.teachinherts.com registration

Herts for Learning expressly reserves the right to terminate registration to the hertsforlearning.co.uk website (either completely or for individuals) at any time and for any reason and Herts for Learning shall have no liability whatsoever for restricting or removing such access.

10. Rights of third parties

Unless the right of enforcement is expressly provided it is not intended that a third party should have the right to pursue any right under this Contract pursuant to this Contracts (Rights of Third Parties) Act 1999.

11. Invalidity of terms

If any provision of these terms shall be unlawful, void or unenforceable for any reason then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

12. Changes to these terms

Herts for Learning may add to or change these terms. It is your responsibility as a user to refer to these terms on accessing this website. Changes will be effective immediately after posting to this website and you will be deemed to have accepted any change if you continue to access this website after that time.  We will indicate at the top of this page the date of such changes to these terms.

13. Law

13.1 These terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13.2 Notwithstanding the provisions of clause 15.1 (above), should this website be accessed by anyone outside of England and Wales, it shall be that person's responsibility to ensure compliance with any locals laws to the extent that they do or may apply.

Additional Terms for Educational Settings

These Additional Terms for Educational Settings are additional terms and conditions which apply to Herts for Learning shareholder schools, Academies, free schools, and other educational establishments (together “Educational Settings”) and should be read in addition to the General Terms of Website Use.  Together, these Additional Terms for Educational Settings and the General Terms of Website Use set out the terms of use on which:

  • you, as an Educational Setting, may advertise jobs on www.teachinherts.com and other sites; (e.g. Tes)
  • on which we provide services to you;
  • you may evaluate job candidates; and
  • candidates may apply for jobs

These Additional Terms apply to any Educational Setting choosing to use the Teach in Herts website.  In the event of any conflict with the General Terms of Website Use, the terms of these Additional Terms shall prevail over the General Terms of Website Use.

When using this service you may place job adverts with services offered by third party suppliers. Each of these services may have its own terms and conditions or licences that apply only to that service and the people that use it. If you use any service you should make sure that you have read all of the terms and conditions for that service.

For the purposes of the Employment Agencies and Employment Business Regulations 2003 this Site operates as a venue only and does not introduce or supply work-seekers to recruiters or vice versa.

These Additional Terms are not intended to, and shall not be deemed to, create any relationship of agency, partnership or joint venture between us and you, or between us and any third party.

1. Teach in Herts website

Herts for Learning Ltd provides the Teach in Herts website in accordance with these Additional Terms for Educational Settings. As part of the Teach in Herts service we will:

  • Enable you to advertise and manage your job vacancies on the Teach in Herts website www.teachinherts.com/find-a-job.htm
  • provide you with reasonable levels of support and advice by telephone and email, in relation to your use of the Teach in Herts website.

2. Job Adverts

When requesting job adverts to be placed on this site, you agree to:

2.1 provide a full, clear and accurate job description;

2.2 provide a rate of pay equal to, or more than the National Minimum Wage, unless a lawful exemption applies [and will clearly state where the vacancy offers a zero hours contract];

2.3 adhere to all relevant UK legislation, and all required licences must be in place;

2.4 adhere to the requirements of UK government departments;

2.5 ensure that all adverts are available to jobseekers on an open and fair basis;

2.6 advertise a job only where a vacancy exists, for example not for the purposes of building a database of potential candidates;

2.7 ensure all apprenticeship job descriptions contain the word 'Apprenticeship' in the job title, and include the qualification that the apprentice will work towards, the length of the apprenticeship and the name of the employer.

3. Vacancy Management

3.1 You agree to:

3.1.1 close the vacancy promptly

3.1.2 not to advertise more vacancies than there are jobs available;

3.2. You shall only collect personal information from applicants where there is a legitimate reason to do so and you shall delete all personal information obtained through the Teach in Herts website upon conclusion of your search for a suitable candidate or in accordance with your obligations under the Data Protection Act 1998, unless the applicant has expressly consented to the retention and continued processing of his/her personal data.  

3.3 Regularly archive jobs and ensure that candidate details are kept for no longer than 1 year.

3.4 Provide feedback to candidates on the status of their application

4. Our obligations

4.1 Subject to the following provisions in this clause 4, we will do our best to make sure that generic content on this site is correct and up to date. If we have missed out any information or any mistakes are identified we will correct it as soon as possible.

4.2 We cannot guarantee the availability or accuracy of data and information of any particular service provided by us or any website which you ask us to advertise your vacancy on (e.g. Teach in Herts,Tes, social media).

4.3 We will not pay damages for any loss that you may suffer because:

4.3.1 of any failure by us to comply with the Website Terms or these Additional Terms, where it is because of circumstances out of our reasonable control;

4.3.2 of a withdrawal of this Site;

4.3.3 you have used, or relied on the accuracy of, the information on Our service; or

4.3.4 disruption to your computer system or damage or loss of data caused by using this Site or as a result of having used the Site. It is your responsibility to have adequate security protection on your computer against viruses, malicious codes and similar threats.

5. Our rights (including limits of our liability to you)

5.1 You shall be solely responsible for satisfying yourself as to the suitability of any applicant who responds to a vacancy and shall be solely responsible for taking up any references and checking qualifications provided by the applicant before engaging him or her and for checking that the applicant is entitled to work in the United Kingdom. We accept no responsibility or liability for the suitability or otherwise of any applicant who responds to a vacancy or who is engaged by you.

5.2 We also exclude all liability to the fullest extent permitted by law in respect of any direct, indirect or consequential loss or damage resulting or arising from any non-availability of our website or from your use of our site.

5.3 We reserve the right not to advertise any vacancy that we believe is unsuitable, and to remove any advertised vacancy that we subsequently believe is unsuitable.

5.4 If you breach the Terms, we may, without notice:

5.4.1 remove your details from the Site and/ or stop you from using the Site;

5.4.2 edit your details held on the Site.

5.5 If we are asked to pay damages because we have advertised your vacancy, you agree to pay those damages back to Us.

5.6 When your account is closed all of the information in it, including saved candidate details, may be marked as deleted by us and removed from our databases.

6. Charges

6.1 Herts for Learning Ltd has the right to make a charge to Educational Settings for the use of the Teach in Herts service.

6.2 Educational Settings who do not pay this charge, will not have access to the Teach in Herts website.

7. Intellectual Property Rights

You shall retain all intellectual property rights in all information, data, text, software, photographs, messages or other materials (“User Content”) submitted for posting or display but you grant us a worldwide, non-exclusive, royalty-free licence in order to reproduce, adapt, distribute and publish that User Content on our website and any other third party’s website (e.g. Tes) which you instruct us to advertise the job application on; and that you also grant that third party a licence on the same terms.  You retain responsibility for protecting those intellectual property rights.   All intellectual property rights, including all copyright and database rights, in all other content shall be owned by us (or third parties).

8. Data protection

Information you provide to us will be managed in accordance with the law, including the Data Protection Act 2018. For further information please read our Privacy Policy.

Teach in Herts - Privacy Policy

Teach in Herts is a recruitment website, owned by Herts for Learning Ltd (HfL), that provides an online platform for Hertfordshire schools, settings, academies and trusts (‘schools’) to advertise their staff vacancies.

This Privacy Policy demonstrates HfL’s firm commitment to data protection. This statement (together with the General Terms of Website Use) sets out the ways that HfL ('the Company, 'we', 'us' or 'our') gathers and disseminates information for the www.teachinherts.com website and what you can do if you have questions about Personal Data.

For the purposes of data protection laws the Company is the joint controller with schools of personal data stored on the website.

The Company does not approve or endorse the schools that hold an account with us. Individuals applying for vacancies advertised by schools on the Teach in Herts website should refer to the relevant school’s privacy notice. HfL is not responsible for the content uploaded by schools to the website or for their data protection practices. 2. WHY WE COLLECT PERSONAL DATA
We collect and hold personal information relating to the schools for which we advertise vacancies, prospective employees, employees and others.

We may share Personal Data with the recruiting schools as necessary under our legal duties or otherwise in accordance with our duties/obligations as a Company.

The Personal Data we are provided with is provided to us on a voluntary basis. Below are set out the reasons why we collect and process Personal Data, as well as the legal basis on which we carry out this processing:

  • to assess the quality of our services: we will process Personal Data so that we may reflect on our own practices to help us improve and provide the highest quality service.

  • to assist with the continuing development of recruitment and retention policies and practices: to enable us and recruiting schools to better recruitment and retention policies and practices, we will process Personal Data of those who have used this website.

  • to contact you: we will process Personal Data to contact you to send you news about products, services and offers that we think may be of interest to you. If you do not want to be kept informed in this way by email, please let us know. You can do this by following the options set out in the "Choice/ opt-out" heading below.

  • to develop our understanding of the workforce and how employees are deployed: to help us create a fully informed, comprehensive picture of the make-up of the workforce and how each employee is utilised as a member of the workforce, we will process Personal Data of those employed to teach or otherwise engaged to work for schools who use this website.

3. LEGAL BASIS FOR PROCESSING PERSONAL DATA
The lawful basis for us to collect/process this Personal Data is that the processing is necessary for the performance of a contract to which the Data Subject is party (whether this be the recruiting school or the prospective employee).

We process Personal Data where processing is necessary for the performance of tasks carried out in the public interest. It is in the public interest to provide educational services to pupils and to engage the workforce in employment.

We also process Personal Data where processing is necessary for the purposes of legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the Data Subject.

We do not process any special categories of Personal Data except where necessary for reasons of substantial public interest in complying with legal obligations including under the Equality Act 2010 or where necessary to protect the vital interests of the Data Subject or of another natural person and where safeguards are in place to ensure that this Personal Data is kept secure. For the avoidance of doubt where special categories of Personal Data are collected it shall not be used for the purposes of
automated decision making and/or profiling.

Special categories of data means Personal Data revealing:

6. WHO WILL HAVE ACCESS TO YOUR PERSONAL DATA
Your Personal Data will be shared with schools as set out in this policy. 

Personal Data will be accessible by members of HfL staff, and where necessary directors.

We will not share information with third parties without consent, unless we are required to do so by law or our policies. We will disclose Personal Data to third parties:

  • if we are under a duty to disclose or share your Personal Data in order to comply with any legal obligation;

  • in order to enforce any agreements with you;

  • in order to perform contracts with third party suppliers for purposes listed in Section 2 (above), to protect the rights, property, or safety of the Company, the recruiting schools, their pupils or others. This includes exchanging information with other organisations for the purposes of child welfare.

This may include our Local Authority, the Department for Education (DfE), the Police and other organisations where necessary.

7. HOW PERSONAL DATA WILL BE PROCESSED
Personal Data may be processed in a variety of ways; this will include but is not limited to:

  • maintaining written records for employment purposes;

  • identification;

  • marketing purposes;

  • sharing information with recruiting schools (please note that we are not responsible for the privacy practices of other organisations);

  • sending by e-mail (whether this be contacting individuals and recruiting schools or responding to enquiries);

  • to improve our services;

  • adding to spreadsheets, word documents or similar for the purposes of assessing Personal Data; for educational software use.

8. WHERE WE STORE PERSONAL DATA AND HOW WE KEEP PERSONAL DATA SECURE
Schools keep paper copies of Personal Data relating to successful applicants, who are employed by the school. Paper copies of Personal Data relating to unsuccessful applicants is securely disposed of by the school after the recruitment process concludes. HfL do not keep any paper copies of Personal Data.

Electronic copies of Personal Data are kept securely and information will only be processed where we are satisfied that it is reasonably secure.

All information you provide to us is stored on secure servers. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our website, you are responsible for keeping this password confidential. You must not share your password with anyone.

When sharing Personal Data to third parties (for example, software providers) it is possible that this Personal Data could be stored in a location outside of the European Economic Area. We will take all steps reasonably necessary to ensure that your Personal Data is treated securely and in accordance with this privacy policy. In particular, any transfer of your Personal Data made by us to a location outside of the EEA will be governed by clauses in a written contract in order to keep these secure. More particularly, this site has security measures in place to protect the loss, misuse and alteration of the information under our control. All instances of unauthorised attempted access to our site are logged and investigated. Where necessary, HfL will inform law enforcement agencies or other relevant organisations regarding misconduct. HfL store your email addresses securely. Your details will not be passed to any organisation beyond HfL, other than the educational establishment(s) which you submit a job application in respect of, without your explicit permission.

9. RETENTION PERIODS
HfL will only retain Personal Data processed by us for as long as is considered necessary to achieve the purposes for which it was originally collected. As a general rule, Personal Data will be kept in accordance with guidance from the IRMS. Personal data may be held for longer periods where extended retention periods are required by law and/or in order to establish, exercise or defend our legal rights. Once the retention period concludes Personal Data is securely and safely destroyed / deleted.

Schools will only keep paper copies of Personal Data relating to successful applicants, who are employed by the school. Paper copies of Personal Data relating to unsuccessful applicants is securely disposed of by the school after the recruitment process concludes.

10. YOUR DATA RIGHTS
The General Data Protection Regulation and associated law gives you rights in relation to Personal Data held about you. These are:

Right to be informed: you have the right to be informed about the collection and use of your data. This policy contains information in relation to the collection of your Personal Data, however, if we collect additional data for other purposes, we will inform you about this.

Right of Access: if your Personal Data is held by the Company , you are entitled to access your Personal Data (unless an exception applies) by submitting a written request. We will aim to respond to that request within one month. If responding to your request will take longer than a month, or we consider that an exception applies, then we will let you know. You are entitled to access the Personal Data described in Section 5.

Right of Rectification: you have the right to require us to rectify any inaccurate Personal Data we hold about you. You also have the right to have incomplete Personal Data we hold about you completed. If you have any concerns about the accuracy of Personal Data that we hold then please contact us.

Right to Restriction: you have the right to restrict the manner in which we can process Personal Data where:

  • the accuracy of the Personal Data is being contested by you;

  • the processing of your Personal Data is unlawful, but you do not want the relevant Personal Data to be erased; or

  • we no longer need to process your Personal Data for the agreed purposes, but you want to preserve your Personal Data for the establishment, exercise or defence of legal claims.

Where any exercise by you of your right to restriction determines that our processing of particular Personal Data are to be restricted, we will then only process the relevant Personal Data in accordance with your consent and, in addition, for storage purposes and for the purpose of legal claims.

Right to Erasure: you have the right to require we erase your Personal Data which we are processing where one of the following grounds applies:

  • the processing is no longer necessary in relation to the purposes for which your Personal Data were collected or otherwise processed;

  • our processing of your Personal Data is based on your consent, you have subsequently withdrawn that consent and there is no other legal ground we can use to process your Personal Data;

  • the Personal Data have been unlawfully processed; and

  • the erasure is required for compliance with a law to which we are subject.

Right to Data Portability: you have the right to receive your Personal Data in a format that can be transferred. We will normally supply Personal Data in the form of PDF files via e-mail. . If you want to receive your Personal Data which you have provided to us in a structured, commonly used and machine-readable format, please contact us via the details in Section 1 of this Notice.

Right to Object: you have the right to object to the processing of your Personal Data where one of the following grounds apply:

  • the processing is based on legitimate interests or the performance of a

  • task in the public interest;

  • the processing is for direct marketing; or

  • the processing is for the purposes of scientific/ historical research and statistics.

12. SUBJECT ACCESS REQUEST (requesting your Personal Data)
You are entitled request details of Personal Data that we hold about you. You are entitled to access that Personal Data by making a Subject Access Request (SAR).

12.1 What is a SAR?
A SAR is a written or verbal request for personal information (known as personal data) held about you by an organisation. Data protection legislation gives individuals the right to know what information is held about them. However, this right is subject to certain exemptions as set out in the Data Protection Act 2018.

12.2 Requesting a SAR
To submit a SAR to HfL we recommend that you submit a written request to our Data Protection Officer at dp.foi@hertsforlearning.co.uk In order to help us to respond quickly and effectively please state clearly what your request is for and include:

  • Your full name and contact details

  • Any information used by the organisation to identify or distinguish you from other people with the same name

  • Any details or relevant dates that will help it identify the information you want.

Your request will be acknowledged in writing and you may be asked to provide proof of identification.

12.3 Verifying identification
When we receive a subject access request we will first check that we have enough information to be sure of your identity. Often we will have no reason to doubt a person’s identity, for example, if we know them personally or have regularly corresponded with them. However, if we have good cause to doubt your
identity we can ask you to provide any evidence we reasonably need to confirm that the person making the request is the individual to whom the personal data relates (or a person authorised to make a SAR on their behalf).

12.4 Gathering of personal data
We will gather any personal information (hard copy or electronic, including emails) and identify any information provided by a third party or which identifies a third party.

If we have identified information that relates to third parties, we will write to them asking whether there is any reason why this information should not be disclosed.

We do not have to supply the information to you unless the other party has provided their consent or it is reasonable to do so without their consent. If the third party objects to the information being disclosed we may seek legal advice on what we should do.

12.5 Timescales
We will deal with your subject access request without undue delay and in line with the statutory requirement (i.e. from the day we receive your request and verification of your identity (if appropriate), whether it is a working day or not, until the corresponding calendar date in the next month, e.g. a SAR received on 3rd September will be responded to by 3rd October.

However, if the work involved is particularly complex or if numerous requests are made then we may extend this period by up to two additional months. In this case, we will inform you about the extension and explain the reasons

12.6 Fee
We will not charge a fee for dealing with your request unless it is ‘manifestly unfounded or excessive’. If we charge a fee, we will inform you of this and explain the reasons for doing so. We may also charge a fee for requests for further copies of information that has already been provided to you.

12.7 Responding to your request
We will explain what steps have been taken in dealing with your request (i.e. we will set out the source of the personal information we have gathered about you). The information will be provided in a concise, transparent and easily accessible format. It may be provided in hard copy or electronically.

12.8 Exemptions
There are a number of exemptions to our duty to disclose personal data and we may seek legal advice if we consider that they might apply. Possible exemptions include information covered by legal professional privilege, information used for research, historical and statistical purposes, and confidential references given or received by the Company.

12.9 Data accuracy
If we agree that any of the information is inaccurate, we will correct it and where practicable, destroy the inaccurate information. If we do not agree or feel unable to decide whether the information is inaccurate, we will make a note of the alleged error and keep this on file.

13. MAKING A COMPLAINT
If you are unhappy with the way we have dealt with any of your concerns, you can make a complaint to the ICO, the supervisory authority for data protection issues in England and Wales. We would recommend that you complain to us in the first instance, but if you wish to contact the ICO you can do so on the details below.
